Meeting with Dato Ketua Pengarah of LLM

Meeting with Dato Ketua PengarahLast week on 24 June 2009, Dato’ Ketua Pengarah of Lembaga Lebuhraya Malaysia organized a meeting to meet the residents representatives regarding the issues highlighted in our email earlier. It was a well represented meeting with relevant organizations like Kementerian Kerja Raya (KKR), Dewan Bandaraya Kuala Lumpur (DBKL), Universiti Teknologi Malaysia (UTM), highway concessionaire and of course LLM themselves.

The meeting provided a platform for us to reestablish our long forgotten struggle and reengage with LLM to seek a resolution to our issues. We were also glad that we were able to share our concerns and highlight any incorrect information that was provided to Dato’ Ketua Pengarah previously.

We presented 3 key issues of which we are seeking resolution to immediately. They are :

1. Long outstanding decision for an amicable solution
Independent studies by Biro Pengaduan Awam and Jabatan Audit Negara confirmed the flaws in the approval of the highway project which has caused a negative impact to the residents. They have recommended the Government to find a solution which included the acquisition of all the affected houses or provide compensation on any loss incurred by the affected residents.

Based on our previous survey conducted with the affected residents, the majority wanted compensation for the loss of market value and cost to mitigate air and noise pollution (eg. installing air conditioning system, double glazed windows, ionisers and exhaust fans).

2. Noise pollution far exceeded the limit approved
Sound engineer sharing expertiseWe also presented our findings where the noise levels have exceeded the approved limit stated in the condition of EIA approval.

We hope that Government is able to provide a better quality of life for the residents living next to the highway by installing noise barriers of appropriate height for both above in the elevated section and below the highway to mitigate the noise impact to the level in compliance with the EIA approval.

3. Outstanding repair work / compensation for houses with cracks
We also highlighted to Dato’ Ketua Pengarah that the repair work / compensation for houses with cracks and the monitoring work by DBKL have halted.

We believe that Dato’ Ketua Pengarah will be able to conduct a thorough review of the progress and resume the initiative to repair / compensate the cracked houses

We sent in an official letter summarizing our meeting with LLM on June 26 of which Dato’ Ketua Pengarah had replied indicating that he will be preparing a report to be sent to Ministry of Works while some of the items needs to be brought to the Minister’s attention for resolution.

We would like to thank Dato’ for looking into this matter on behalf of the affected residents and hopefully we can see the light soon.

The exact details of our letter can be found here. [page 1][page 2][page 3][page 4]

My experiences with the Minister and the PAC

Dear Editor,

My name is Lau Kien Foh and I’m the Chairman of Sri Petaling Residents Action Committee. This is my response to the article by Mr. R.Nadeswaran on “Heeding the call of the PAC” published on June 21.

Dear Nadeswaran,

I read your article on “Heeding the call of the PAC” yesterday. On behalf of the people whom their houses affected by the construction of the dedicated highway to Putrajaya, I can testify to your point raised in the article. I had the opportunity to “confront” the minister outside the Parliament and also the meeting with the minister in his office, where he invited almost 20 of his senior officials. My conclusion is “the man” belongs to different generation and has a different mind-set. He may be dedicated to his work and his boss, but he is definately not rational, not people sensitive and not reasonable. I’ve also highlighted in my letter to him that as a cabinet minister, his approach to delivery must be “holistic” and not “silo”. He must demonstrate the leadership role to ensure all government agencies are geared toward delivering projects that will not “victimise” the people.

On your comments for PAC, I totally agree with you. Again, I have the opportunity to work with the current PAC, led by Shahrir and his company. They are pro-active, rational and fact-based in its approach. I wish they could be given more resources to carry out their work.

However, on your point about the “secrecy” of the PAC hearings, I must point out to you that upon request, I was allowed by Shahrir to attend as an observer in one of their recent hearings (where the dedicated Putrajaya highway issue was discussed). I’m not sure whether it is open to the public but certainly, as an interested party, I find the hearings very informative and constructive. I also observed the professionalism demonstrated by the PAC members in understanding and discussing issues. What impressed me most was the discussion was totally non-politics and no “side-show” (as you may be aware that the PAC comprises MPs from both government and opposition parties).

Meeting with the Minister of Works

Meeting with the Minister of Works

Resident representatives meeting with the Minister of Works

On 17 October, 2005, I received a SMS from YB Teresa Kok that Works Minister, YB Datuk Seri S. Samy Vellu has requested her to convey a notice for meeting with the residents’ representatives to be held on 19 October at 4pm. Subsequently, I received calls and fax from the authorities informing the meeting with the Minister. The conditions were that the representatives are limited to three and no media should be invited.

Our action committee had an emergency meeting and nominated three representatives as follows:

  1. Lau Kien Foh – Overall representative
  2. Au Lai Koong – Represent Zon N
  3. Sallehudin – Represent Zon L

We also agreed on the strategy and action steps. We decided to take the opportunity to show all the documentation evidence and convince the Minister on our positions.

On 19 October 2005, our team arrived at the ministry half an hour before the meeting and soon joined by YB Teresa. We were invited into the meeting room around 4pm. In the meeting room, there were about 20 senior officers from the authorities. We took the opportunity to introduce ourselves and also get to know them. About 10 mins later, the Minister walked into the meeting room and shook hands with us.

Samy to meet Sri Petaling reps

From the desk of The Star

Wednesday October 5, 2005
Samy to meet Sri Petaling reps
KUALA LUMPUR: The RM1.2bil Kuala Lumpur-Putrajaya Highway project will go on but Datuk Seri S. Samy Vellu will meet repesentatives of the Sri Petaling residents to find a way to resolve their problems.
The Works Minister however said that because the highway was on Government land, compensation was out of the question for the residents who complained that the walls of their houses cracked due to the construction works.
“We are not occupying the land. If we were to pay compensation, we would be setting a bad precedent,” he told newsmen after meeting Finland’s foreign trade and development minister Mari Kiviniemi at his office here yesterday.
Samy Vellu said the ministry had written to the housing developer Seri Petaling Development in 1996 of its intention to acquire the land to build the Kuala Lumpur-Putrajaya-KLIA Highway. (The Putrajaya-KLIA phase was later scrapped.)
“Due to the economic crisis then, the construction of the highway was delayed but the developers went ahead with the houses,” he said.
Samy Vellu said the Government had so far spent RM400mil on the highway which was expected to lighten traffic flow along the KL-Seremban Highway.
He said noise barriers would be built along the boundary of the highway and the residential area to shut out the din from traffic.

Protest at Malaysia Parliament House

While all the effort to communicate and resolve our issues ignored, the residents decided to stage a protest at the Malaysia Parliament House during one of the sitting.

The residents conducted a peaceful protest at the Parliament on the 19 Sept 2005. Arriving in the morning, close to about 100 residents of Sri Petaling lifted their spirits and colorful banners to voice their displeasure for the construction of the highway so close to their homes.

We prepared a memorandum to be handed to some of the Members of Parliament for the purpose of highlighting our struggle. We met Dato Shahrir Samad who is the chairman of Backbenchers Club and Public Accounts Committee (PAC). He received our memorandum and agreed to investigate into the matter. We also distributed leaflets which was circulating in the House hoping the Works Minister would take notice our effort to contact him.

Here are some of the selected pictures . (Click on the pictures to see the whole gallery)

We finally managed to meet the Works Minister, Samy Vellu and he mentioned a few statements regarding the project indicating that he is not afraid to meet the residents because he is NOT in the wrong. He got all fired up and screamed when one of the residents made a harsh but true comment about him and the project.

The following were some of the achievements during the protest.

  1. We managed to achieve the following at the parliament picketing
  2. Distributed about 400 flyers to all passer-by going in and out of the Parliament
  3. Met up with Dato Shahrir, Chairman of Public Accounts Committee to present our case
  4. Press interview with ntv7
  5. Finally we managed to meet Datuk Seri S Samy Vellu on his way out of the Parliament

We hope the Minister would seriously look into our request this time.
