Letter to Ministry on new guideline of minimum 3 meter setback

Dear YB Datuk Seri,

KL-PUTRAJAYA HIGHWAY - 3 Meters Setback for Highway; Inconsistencies between Ministry of Works, Dewan Bandaraya Kuala Lumpur and Petaling Garden Sdn Bhd.

With reference to our letter dated 24 October 2005 and the recent press statements made by YB Datuk Seri on the above matter.

Again, I must say that I read with interest that YB Datuk Seri has agreed to impose a 3 meters setback on both sides of highways. On behalf of the residents of Sri Petaling, we feel flattered by your statement that the decision was reached after considering feedback from us.

YB Datuk Seri, I’m sure your Ministry must have conducted some studies before arriving at the 3 meters setback requirement. As you may be aware, the setback requirements for highway development in developed nations are no less than 19 meters. There are many reasons for imposing a 19 meters setback. We would appreciate if YB Datuk Seri could arrange a meeting session for us to understand the rationales of 3 meters and not 19 meters setback for highway development at your earliest convenience.

We also noted that YB Datuk Seri has again brought up the issues of “negligence” or “disobedience” by Dewan Bandaraya Kuala Lumpur (DBKL) and the Developer (Petaling Garden Sdn. Bhd.) that caused the problems face by us today.

As discussed in our meeting with YB Datuk Seri on 19 October 2005, we have met up with DBKL and Petaling Garden Sdn Bhd separately. In our meetings with them, they have denied “disobedience” as claimed by YB Datuk Seri and further stated that they have complied with the necessary requirements.

In view of these inconsistencies, we appeal to YB Datuk Seri to assist us by chairing a meeting to include Ministry of Works, DBKL, Petaling Garden and us to identify and conclude on the causes of our issues, and to arrive at an amicable solution by all parties involved.

We look forward to hearing from YB Datuk Seri soon to continue our discussion on the above issues and proposed solutions.
