HELP US STOP THIS MENACE IN SRI PETALING RESIDENTIAL AREA

More than 200 families and 1000 residents along Jalan 2/149, Bandar Baru Sri Petaling are directly affected by the Project. We are very much concerned as the PROJECT had already started ignoring all the issues with respect to safety and environmental impacts the residents has raised.

Even though you may not be affected by this project, please raise your voice and help us to prevent our livelihood being destroyed and our health and safety being threatened. We are deeply saddened by how decisions are made by the relevant authorities while ignoring the Rakyat's plight. Some of the residents have bought what they believed to be 'homes' and chances are it will be the only home that they will ever be able to purchase. Imagine how you would feel as a taxpayer where your own money contributed to the Government is used to destroy your only home!

Background Information

The KL-Putrajaya highway Project with 26KM length, from Kampung Pandan roundabout to Putrajaya. The concession was signed on 22 October 1997.

Divided into several construction packages, package 5 of this Project starts from Salak South Garden, pass through an established residential area, i.e. Bandar Baru Sri Petaling and end at Bukit Jalil. The stretch in Bandar Baru Sri Petaling with approximately 1.25KM will be an elevated structure to be built on the existing road, Jalan 2/149, which has 32metres reserve width that services the residential area.

The authorities was informed to reserve adequate land buffer for the construction when it was available but land was 'lost' due to a blunder... [read on]

6-lane high speed KL-Putrajaya highway is to be built

The above service road is only 106 feet wide and the Government says that it is adequate to construct the 6-lane high speed highway to Putrajaya.

Issues With Respect To Authorities’ Approvals Of The Project

Issue No 1 - Relevant laws, acts, guidelines and regulations have not been complied.

Issue No 2 – Important concepts and pertinent information were not provided in the Environment Impact Assessment (EIA) reports, which defied the objective of EIA.
Supplementary EIA was made to 'hide' relevant information such as the 2.3 meters away from houses.

Issue No 3 - The relevant authorities failed to carry out their responsibilities
DBKL approved housing project despite knowing that highway is to be built on existing land [read on]

'Rakyat' should not be made to compromise with

  • non compliance of laws, acts, guidelines and regulations
  • non compliance of National Environmental Policy
  • unreasonable proposal
  • infringement of public rights
  • sub standard town planning
  • environmental impacts and hazards

Stand Firm : Fight for our right, our health, our safety, our livelihood and stop such Government power abuse.

Chronology of events
As the project has direct impact to the residents in Sri Petaling, the residents have on many occasions and through many channels voiced their concerns to the relevant authorities. But, unfortunately, to-date there is no formal response provided. [Click here to find out more about what happened]

Responses from Ministry of Works - Aug 2005

Malaysian Minister of Works,
Datuk Seri S. Samy Vellu

Actual SMS reply from Minister of Works when Member of Parliament, YB Theresa Kok attempted to seek an opportunity for residents to meet the Minister, Datuk Seri S. Samy Vellu.

"YB Theresa no one can stop this RM 1.3 billion project The road is within our ROW. Any ATTEMPT to stop work means heavy Compensation..Sorry. Samyvellu" - Short Message Service reply on Aug 8, 2005
Resident's Dilemma - Residents are not capable of taking legal action against Govt as 'Heavy Compensation' is involved.

"YB Theresa The Sri Petaling residents objection overruled. The Government is compelled to build the road on land acquired by the Govt paying several hundred millions ringgit. That project is important to ease the traffic in KL/Seremaan Highway. samyvellu" - Short Message Service reply on Aug 7, 2005
Resident's Dilemma - The Govt 'FORGOT' to acquire adequate land in Sri Petaling which was AVAILABLE when the project was approved in 1997. In year 2000, available land was developed into middle class housing. Unsuspecting buyers bought houses and now victims of a federal Govt project!

"YB Theresa This project is already there before the Housing project. This is neither a new acquisition nor a new project. The government has paid heavy compensation to do this alternate protocol dedicated highway. No further delay or meeting with anyone will be allowed. The job will go on. Sorryi Samyvellu." - Short Message Service reply on Aug 8, 2005
Resident's Dilemma - Malaysian Govt knew about the planned housing project. They also know about the inadequate width for the elevated highway but DID NOTHING to acquire available land then. Unsuspecting buyers bought houses built on the then 'available KL-Putrajaya Highway land'. Why didn't the Govt acquire adequate land when it was available?

Do you know?

LLM, DBKL, DOE say they are not aware about the sheer proximity of the highway to the homes!

A resident has written to the authorities way back in 1997 to realign the Right Of Way of the highway to utilize the undeveloped Zone N. [click here to see the letter and how it fell on deaf ears of the authorities]

The developer of Zone N (Petaling Garden Berhad) managed to obtain approval to build houses along a path of designated federal highway. How can that be?
